General Terms and Conditions of MotoWorldTours (MWT) Version: 20.10.2026 A) General conditions for concluding a contract with MWT 1. Contracting party Your contracting party for all services and goods offered on this website is: MotoWorldTours Marc Collins Wachtelberg 10e 15378 Hennickendorf Germany Phone: +49 33434 807344 Mobile: +49 151 156 76 027 Email: info@motoworldtours.com 2. Conclusion of contract A contract with us is concluded by an offer and its acceptance. Our online presentation does not constitute an offer in the legal sense, but an invitation to submit offers to conclude a contract. You can submit an offer to conclude a contract for an event or goods (hereinafter for events and goods: "Article") by placing the Article in the virtual shopping cart and clicking the "Order with obligation to pay" button at the end of the ordering process. With express checkout, you submit the offer by clicking Apple Pay or Google Pay. You will then receive an email confirming receipt of your offer (order confirmation) – immediately for payment by bank transfer, and for online payment as soon as the payment has been received or is being processed as a SEPA direct debit. Your offer is accepted, and the contract thereby concluded, by delivery of the goods and dispatch of a corresponding email (shipping confirmation), or, for events, solely by dispatch of the email. We only accept orders for the delivery of goods within Germany and the EU. Contracts for tours, events and trainings are concluded without such restrictions. 3. Customer account You can order without a customer account. A customer account is created when you sign in with your email address and a code that we send to you by email; in it you can see your orders, invoices and the shipping status. You can delete the customer account yourself at any time; orders and invoices are retained because of the statutory retention obligation. B) Provisions for leisure events, trainings and tours 1. Scope of services, changes to services and prices The scope of services of the leisure events (e.g. U.B.B.O.M., individual training, enduro training or tours) results from the description of services on which the registration is based. Before the contract is concluded, MWT may change the descriptions of services at any time; the participant will of course be informed of such changes before booking. 2. Terms of payment For online payment, the event or training fee is payable with the order. For payment by bank transfer, it becomes due on the date shown after the order and stated in the order confirmation; this date is no later than three days before the start of the event. 3. Cancellation of events & tours If the customer wishes to cancel participation in the leisure event for personal reasons, the following cancellation fees apply: • up to 5 weeks before the event: 0% cancellation fee of the amount ordered • up to 2 weeks before the event: 50% cancellation fee of the amount ordered • less than 2 weeks before the event: 100% cancellation fee of the amount ordered There is no entitlement to rebooking / exchange, or to a credit for a booking or a date. A rebooking may be carried out by MWT, but in that case constitutes a purely voluntary goodwill arrangement. A handling fee of 20 euros incl. VAT is charged for a rebooking. In the case of an alternative date, this is determined by MWT after consultation with the customer. The customer cannot freely choose the date. Please understand that a medical certificate / sick note from a doctor etc. likewise does not override the cancellation / withdrawal rules described above. To avoid a loss in the event of cancellation, we recommend taking out separate travel cancellation insurance. 4. Right of withdrawal For leisure events, the customer has no right of withdrawal pursuant to Section 312g (2) No. 9 BGB (German Civil Code). 5. Risk information and exclusions Every rider must hold a valid driving licence and must not be subject to a driving ban. The rider must be fit to ride at the time of the riding event and in particular must not be under the influence of alcohol. The riders undertake to observe the risk information under C)1 and to comply with the rules of conduct and restrictions contained therein. They must strictly follow the instructions of the instructors. Riders who do not comply with the rules of conduct or instructions will be excluded from the event. Within the limits of their riding ability, the rider is obliged to always ride and behave so carefully that any danger to others beyond the mere use of the track is avoided. If special incidents (fall, accident, change of the track due to wear or special events such as fallen trees) create dangers that are unknown to other riders, the rider must inform an instructor immediately and without delay. In case of imminent danger, the rider must immediately warn the following riders in a suitable manner. 6. Motorcycle and protective clothing Every rider may only take part in the event with a roadworthy and off-road-worthy motorcycle. Only off-road and enduro motorcycles are permitted. The rider is personally responsible for the safety of their vehicle. The instructors must prohibit (further) riding with the motorcycle used if a safety defect is found. A helmet must be worn whenever riding during the entire event, even over short distances. Further protective clothing (in particular enduro boots, gloves, knee, hip and shoulder protectors) is strongly recommended. Each rider decides on this on their own responsibility within the scope of voluntary self-endangerment. 7. Limitation of liability For damage suffered by the participant in connection with an ARTICLE (definition: see 2.), MWT's liability is limited to twice the ARTICLE price, insofar as the participant's damage was caused neither intentionally nor through gross negligence. Within the scope of the contract, the cardinal obligation consists in particular in the (defect-free) delivery of the ARTICLES ordered. In this case, liability is limited to the foreseeable damage typical for the contract. The amount of liability is limited to twice the ARTICLE price. 8. Emergency doctor At some events we arrange, as a precaution, for an emergency doctor to be present on site. There is no entitlement to this. In particular, the emergency doctor may have to cancel at short notice or leave the site because there was an incident and they are accompanying a patient to hospital. C) Risk information 1. General information • The customer rides their own motorcycle or a rented motorcycle in more or less rough terrain. • The rider must be aware that they will probably not complete the event without falls. As a rule, these are minor, so that no physical injuries occur and the motorcycle suffers no or only minor damage (bent gear lever, broken predetermined breaking point on the brake or clutch lever). In individual and exceptional cases, however, greater damage cannot be ruled out. MWT therefore recommends removing windshields, mirrors and panniers. • We assume that riders are physically fit and healthy enough to complete the event without damage in this respect. Especially for events lasting several days, we ask riders to adjust their alcohol consumption the evening before accordingly. During riding times, a limit of 0.0 ‰ applies to riders, i.e. an absolute ban on alcohol. • In order to cope with the different routes with as little damage as possible, the rider should ask themselves carefully in advance which category corresponds to their riding ability and riding experience. MWT recommends in any case starting with the easy loop, also to warm up. • MWT may interrupt or cancel an event at its dutiful discretion if the weather conditions create a hazardous situation that makes continuing appear too dangerous. • The participant is obliged to cooperate within the framework of the statutory provisions in the event of any disruption of performance, and to avoid or minimise any damage. In particular, the participant is obliged to report complaints immediately to the local tour management. The tour management is instructed to remedy the situation where possible. If the participant culpably fails to report a defect, no claim to a reduction arises. 2. Categorisation of the requirements of our tours and events a) Easy Adventure The rider should have taken part in at least two one-day enduro trainings or have practised off-road (i.e. not only on gravel roads) several times themselves, and be physically fit. Narrow paths on hard-packed earth with stones and gravel, including in the forest, may have to be ridden. The paths are not level and may slope or have potholes, which may also be filled with water, so that the depth cannot be predicted exactly before riding through. The machine is therefore not always steerable and controllable as usual. Riders should only stop at points with a clear view in order to avoid collisions. Light climbs and descents have to be ridden. The ground is not always firm; there may be passages with sand, loose gravel, wet wooden planks (bridges), mud and water, so that a wheel may slip. In the forest, particular care must be taken that the handlebars do not get caught on a branch or tree. b) Classic Adventure The rider should have routine experience of off-road riding and many years of motorcycling experience. In addition to the terrain requirements under a), the rider may face tracks that are strongly inclined to the side, step-like terrain with steps of up to 40 cm that have to be ridden downhill, deeper water crossings (40 cm), and physically demanding terrain formations requiring not only skill but also strength and stamina. Longer climbs and descents with gradients of up to 40% have to be ridden. Riders must expect the machine's skid plate to touch the ground at individual points. c) Hard Adventure A route for experts. Off-road riding should be familiar to the rider. Riders who feel comfortable here have years of off-road experience, possibly also through taking part in enduro rallies, and can move almost as confidently off-road as in road traffic. In addition to the route sections described under a) and b), every conceivable type of off-road surface can be found, as well as climbs and descents of up to 100 metres with a gradient of up to 80%. It cannot be ruled out that the machine gets stuck and can only be brought back onto the track with outside help. d) Support If the rider is not sure which category they can manage, or whether they are able to manage the easy route at all, MWT will, on request, carry out a test ride, not necessarily on the closed-off route, to support the rider's own assessment. e) Introductory lap for events at fixed venues Before the track is opened, we do an introductory lap with the riders, in which an instructor/guide rides the lap with the riders. At critical points, the instructor stops and points out risk areas. Due to the running engine noise, they will not always be understandable. If something has not become clear and the rider needs the verbal information, please raise your arm. The instructor/guide will then ensure that the rider receives the verbal information on the spot. In cases where a verbal explanation is essential for safety reasons, the instructor/guide will ensure that the machines are switched off so that everyone can understand them. c) Conduct of riders If an emergency doctor is present at the event, their mobile number will be announced at the start of the event. Every rider should save this number in their mobile phone so that it is quickly at hand in an emergency. Riders on the track must behave in such a way that danger to others is avoided. Consideration must be shown for slower and more cautious riders. Riders should rush to help anyone who has fallen, above all to check whether the rider is injured. Riders must follow the risk information, rules of conduct and the instructions of the instructors/guides. D) Supplementary provisions for the purchase of goods 1. Scope of services The scope of services of the goods purchased results from the description of the respective item on the website, which can also be seen in the respective shopping cart. 2. Shipping and shipping costs Where possible, we send you the goods in a single shipment to your billing address. We do not charge shipping costs. 3. Prices / payment options / retention of title No shipping costs are added to the prices stated. The customer must pay in advance for goods and events – by bank transfer free of charge for MWT or by online payment (see E). Irrespective of this, the goods remain the property of MWT until paid in full. 4. Returns For returns due to withdrawal or warranty, please contact info@motoworldtours.com. 5. Warranty The warranty for goods is 2 years, calculated from the date the buyer receives the goods. The warranty period is only one year if the buyer is an entrepreneur and buys the goods for their business activity. The statutory limitation periods for the right of recourse under Section 478 BGB remain unaffected. E) Terms of payment The customer can pay in advance by bank transfer – using the payment details from the order confirmation – or pay online. Online payment (elvioPay) is processed by the payment service provider Stripe, e.g. by card, Apple Pay, Google Pay or SEPA direct debit; the shopping cart and checkout show which payment methods are available for an order. If a payment by bank transfer has not been received at the latest two days after the due date stated in the order confirmation, the order will be cancelled; reserved places and goods will be released again. Goods are delivered once payment has been received by us. We reserve the right not to offer certain payment methods for any order and to refer to other payment methods. F) Invalidity of individual provisions The invalidity of individual provisions does not result in the invalidity of the entire tour, event or training contract. G) Place of jurisdiction The court having local jurisdiction for Rüdersdorf OT Hennickendorf is agreed as the place of jurisdiction for all actions arising from this contractual relationship, insofar as this is legally permissible.
